Welcome to Henry’s Secret LLC (“Henry’s Secret”, “we”, “us”, or “our”). We operate this website and store to provide limited-release, small-batch ice cream products for local pickup. By accessing or using our website or purchasing products, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our Services.

ELIGIBILITY

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services.

LIMITED DROP MODEL

We operate on a limited-release (“drop”) model. Products are released in small quantities and may sell out quickly. Availability is not guaranteed. We reserve the right to modify or cancel any drop at any time.

PRODUCTS (PERISHABLE GOODS)

All products are perishable food items (ice cream). Products must be picked up promptly. We are not responsible for product condition after pickup. Product descriptions may change at any time.

PICKUP POLICY

All orders are pickup only.

Orders can be picked up on Saturdays and Sundays at 9163 W Sunset Blvd, West Hollywood, CA 90069 from 11AM-7PM Orders from previous weeks’ drops will also remain available for pickup for 7 days.

Disclaimer: Pickup details may vary by drop. It is your responsibility to review any drop-specific pickup instructions. Orders not picked up within the designated pickup period may be forfeited.

 

NO REFUNDS / FINAL SALE

All sales are final. We do not offer refunds, returns, or exchanges due to the perishable nature of our products. Exceptions may be made at our discretion for incorrect or unfulfilled orders.

NO RESALE

Products are for personal use only. You may not resell or commercially distribute our products. We reserve the right to cancel orders or refuse service if resale is suspected.

ORDERS

Placing an order does not guarantee acceptance. We may cancel or refuse orders at our discretion. You are responsible for ensuring your order details are correct.

PRICING

Prices are subject to change without notice and are listed in USD. Taxes may apply.

SMS & EMAIL MARKETING

By providing your phone number or email, you agree to receive order updates, drop notifications, and marketing messages. Message frequency may vary. Standard message and data rates may apply. You can unsubscribe at any time.

Mobile Terms of Service

The Henry's Secret mobile message service (the "Service") is operated by Henry's Secret (“Henry's Secret”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Henry's Secret’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Henry's Secret through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Henry's Secret. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18663298409 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Henry's Secret mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

INTELLECTUAL PROPERTY

All content on this site is owned by Henry’s Secret LLC and may not be used without permission.

LIMITATION OF LIABILITY

We are not liable for missed pickups, product condition after pickup, or any indirect damages. Products are consumed at your own risk.

DISCLAIMER

All products and services are provided “as is” without warranties of any kind.

TERMINATION

We reserve the right to refuse service or terminate access at any time.

GOVERNING LAW

These Terms are governed by the laws of the State of California.

CHANGES TO TERMS

We may update these Terms at any time. Continued use of our Services means you accept those changes.
